THIS LIMITED WARRANTY IS IN LIEU OF AND EXCLUDES
ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED
WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
COMPLETE ASSEMBLY/LONG BLOCK (Short Block
with heads, assembled by Motor Replacement Co., Inc.) Domestic and
Import
PASSENGER CARS (Includes
Vans and Pickup Trucks up to & including ¾ ton for personal use)
are warranted for a period of 36 months or 75,000 miles, whichever
occurs first.
TRUCKS (Includes Passenger cars, Vans, and
Pickup Trucks in commercial use and Vehicles one ton and over with
highway usage, and engines with "RV" suffix on part number ). Are
warranted for a period of 24 months or 24,000 miles, whichever occurs
first.
MOTOR HOMES AND BUSES are warranted for a
period of 12 months or 12,000 miles, whichever occurs first. (Maximum
labor adjustment of $750.00 for Motor Homes, applicable only on
part numbers designated by The Company for Motor Home use, and $650.00 for
bus applications.)
SHORT BLOCKS (Passenger Cars and Trucks)
are warranted for a period of 90 days or 4,000 miles, whichever
occurs first.
MARINE APPLICATIONS are warranted for a period
of 12 months, applicable only on part numbers designated by The Company
for marine use.
INDUSTRIAL, STATIONARY, OR OFF ROAD APPLICATIONS
(Complete and Short Blocks) are warranted for a period of 45 days,
if used for purposes intended by the original manufacturer.
RACE, AND /OR HOT ROD APPLICATIONS are excluded
from any and all warranty coverage regardless of cause.
THIS LIMITED WARRANTY COVERS DEFECTIVE WORKMANSHIP
OR MATERIALS ASSEMBLED BY US AND IS NOT AN UNCONDITIONAL GUARANTEE
AGAINST ALL HAZARDS OR FAILURES. The Company RESERVES THE RIGHT TO CORRECT
ANY FAILURES IN SUCH MANNER IT DEEMS NECESSARY AND PROPER.
EXCLUSIONS FROM WARRANTY COVERAGE
Remanufacturer does not warrant against and/or will not pay for
or provide, (but not limited to):
(1) Overheating (Heat tab activated, distorted,
melted or removed will void this warranty); (2) Failure due to improper installation, maintenance neglect,
abuse, abnormal operations, freezing, or accident;
(3) Failures due to components not furnished with an engine
remanufactured by us or otherwise approved by us for installation,
or malfunction of or disconnected engine support system items, or
components unsuitable for use with a warranted engine or part; (4) Internal Engine Damage due to foreign material or failure
because of operations causing greater than normal wear, or from
use of an engine for purposes other than those for which it was
originally intended by the manufacturer; (5) Damage from detonation /pre-ignition, thermal expansion,
or foreign material in combustion chamber; (6) Valve adjustments, including jet valves; (7) Crankshaft thrust surface worn due to excessive external
pressure;
(8) Replacement labor (except as set forth herein), gaskets,
shop supplies or EPA charges, or other items associated with but
not including warranted engines and parts; (9) Towing, vehicle rental, or transportation charges or
any other losses incurred in the operation of warranted engines
or parts, or incurred due to the failure of warranted engines or
parts; (10) Oil consumption in Short Blocks (Engines purchased without
cylinder heads), or any damage due to camshaft failure if new lifters
have not been installed; (11) Bad gas (when gasoline is left in the tank of an idle
vehicle for a time long enough to lose its original qualities) (12) The Company will not be liable for wrong installations due to
catalog information, manufacturer changes or engines ordered in
error, or repairs to engines in vehicles which the odometer is not
operational; (13) Failure due to old oil-cooler and all external oil lines
not being replaced; (14) Problems due to an engine change (type for type) from
the original application; (15) No labor will be paid for units installed by persons
that are not ASE Engine Certified or equivalent certified rating,
and in a facility open to the general public for business with a
valid business license; (16) Engines installed in Motor Homes which The Company does not
designate for Motor Homes; (17) Use of any parts not installed by us or not of original
equipment application such as performance or special camshafts,
carburetion, manifolds, tires not of OEM specifications etc. will
void this warranty; (18) Gaskets and components not installed by the The Company factory
are the responsibility of the installer and are not covered under
warranty; (19) Failures caused from engine being operated with any
fuel other than gasoline (propane, LPG and etc.), or with turbochargers
except when specified by The Company for use with other fuels or turbochargers. (20) Any repairs prior to having authorization from The Company Customer
Service Department in Phoenix, AZ.;
TO ASSURE PROPER PERFORMANCE AND REGISTRATION
OF YOUR WARRANTY, THE "CERTIFICATE OF INSTALLATION" MUST BE FULLY
COMPLETED AND MAILED TO THE REMANUFACTURER WITH IN (10) DAYS FOLLOWING
THE DATE OF INSTALLATION. FAILURE TO RETURN THE COMPLETED CERTIFICATE
OF INSTALLATION WILL LIMIT WARRANTY COVERAGE TO 12 MONTHS OR 12,000
MILES WHICHEVER COMES FIRST.
ADDITIONAL LIMITATIONS Remanufactures liabilities are limited solely and exclusively
to repair or replacement of engines or parts within the continental
United States according to the terms of this warranty alone and
do not include liability for any incidental, consequential damages,
lost wages or time, or other damages of any kind whatsoever, whether
any claim Is based upon theories of contract negligence or tort.
This warranty may be distributed in a state(s) which may not allow
the limitation or exclusion of some warranties or of incidental
or consequential damages. In the event that any provision of this
warranty should be or become invalid or unenforceable, the remaining
terms and conditions hereof shall remain in full force and effect.
ADDITIONAL WARRANTY INFORMATION
To assure a long and satisfactory engine performance be certain
the The Company instructions in the Owner's Manual are satisfied, and be
sure to follow up with the 500 Mile Service Check, and mail in the
"500 Mile Check-up Certificate'. Applications using Propane, L.P.G.,
or Turbochargers must be special ordered if a listing does not appear
in our catalog. The use of standard production units in these applications
will result in failure and are not warrantable. If it is determined
the failure was caused by defective workmanship or materials assembled
by us, Motor Replacement Co., Inc. will make a labor allowance of
forty five dollars ($45.00) per hour, based on Motor's Flat Rate
/ All Data Time Guide. (Do not confuse this with customer retail
labor). Maximum adjustment for labor is $650.00 for passenger
car and truck. The warranty term commences on the "Date of Installation",
which is the date on which the remanufactured engine or part is
first installed in, or attached to, or affixed to the vehicle, apparatus,
stand, or appliance from or on which it is to be operated by the
first buyer for use. Replacement of a warranted engine or part does
not extend the warranty term. This limited warranty is transferable
provided the "Certificate of Installation" was received by The Company fully
completed within 10 days of installation and we receive written
notification of the change of vehicle ownership.
THIS IS THE COMPLETE WARRANTY AND NO ONE IS AUTHORIZED
TO EXTEND OR ALTER THIS WARRANTY ON BEHALF OF MOTOR REPLACEMENT
COMPANY, INC.
INSTALLERS RESPONSIBILITY (1) The installing mechanic must be ASE Certified (or
equivalent) in Engine Repair and Engine Diagnostics. (2) The installer must follow the Engine Support System Check
List and Installation Instructions in the Owner's manual. Failure
to do so will void this warranty. (3) The installer must have vehicle checked to diagnose the
status of the Engine Support System (computer, fuel injection, sensors,
etc.) to certify it is in proper operating condition before delivery
of vehicle to owner (Damage caused to the engine by a malfunctioning
support system is not covered by warranty). (4) The Installer must give the Motor Replacement Co., Inc.
warranty and completed installation papers to the vehicle owner.
ADJUSTMENT PROCEDURE
In order to obtain performance of any obligation under this warranty,
the vehicle owner should do the following: (1) Contact the installer who performed the installation. (2) Have the problem diagnosed without disassembly of The Company
product. The Company does not assume liability for wrong diagnosis. (3) Contact the The Company factory Customer Service Department before
proceeding with any repair work. (A) Communicate nature of problem, part number, work order
#, date of installation, mileage,
and invoice #.
(B) A reference number will be assigned by The Company Customer Service
Department for tracking purposes only. It is most important that
this reference number be included in all future correspondence.
(4) All parts used for repair must be furnished by The Company unless
otherwise directed. (In the event we determine that only in chassis
repairs are necessary, we will reimburse the purchaser for that
necessary labor in accordance with our published labor schedules
for that repair and the cost of necessary parts at jobber cost if
not provided by us. Any outside repair work must be guaranteed by
the person or company doing the work. (5) Take reasonable steps to protect the alleged defective
engine or part from further use, damage, or contamination. (6) Return all of the alleged defective engine or part as
supplied to the factory (Phoenix, AZ.) for complete factory inspection
freight prepaid, unless otherwise instructed by The Company Customer Service.
Freight collect shipments will be refused. Any product that is returned
by purchaser that The Company Customer Service determines not to be warrantable,
or was not originally supplied by The Company will be returned at purchaser's
expense. (7) Factory inspection of alleged defective engine may require
complete disassembly of the unit. (8) If after factory inspection The Company determines the failure
was caused by defective workmanship or materials assembled by us,
we will reimburse the purchaser for the cost of the replacement
engine (providing it was purchased from Motor Replacement Co., Inc.),
the cost of labor in accordance with our published labor schedule,
the cost of gaskets and parts at jobber cost if not provided by
The Company; $15.00 allowance for oil, oil filter and anti-freeze; and freight.
No labor will be paid for new return or refunded engine. (9) When submitting a paid repair order for reimbursement,
the following information must be included: (A) Dealer from whom
engine was purchased. (B) Reference number, part number, and work
order number. (C) Owner's name, mileage, and VIN number (D) Copy
of original itemized installation work order. (10) Your paid repair order must be received by The Company within
thirty (30) days after completion of repairs.
